Trump was indicted on felony charges for mishandling classified documents after hiding them and falsely certifying he had returned everything - June 8, 2023
Details
All presidential documents must be returned by the end of their term to the National Archives and Records Administration (NARA).
NARA first learned Trump kept documents at Mar-a-Lago in May 2021 and began repeatedly demanding their return. Trump returned 15 boxes in January 2022 and certified all documents were returned in June 2022. The FBI discovered this was not true and conducted a search of Mar-a-Lago, finding dozens of boxes with 102 documents carrying classified markings.
The documents "included information regarding defense and weapons capabilities of both the United States and foreign countries; United States nuclear programs; potential vulnerabilities of the United States and its allies to military attack; and plans for possible retaliation in response to a foreign attack." Some documents were marked "SECRET", "TOP SECRET", or "CONFIDENTIAL". They were stored in "a ballroom, a bathroom and shower, an office space, his bedroom, and a storage room."
In a recorded meeting at Mar-a-Lago in July 2021, Trump showed a plan of attack to individuals without security clearance, stating the plans were highly confidential and, "as president, I could have declassified it. Now I can't, you know, but this is still a secret."
A Trump-appointed judge dismissed the case on July 15, 2024 after finding the appointment of the special counsel who investigated Trump to be unconstitutional.
